Part I—“The Basics”
Cyber threats continue to create serious risks for organizations and individuals. Recent reports show that many cybercrime metrics are moving in the wrong direction. Fortunately, insurance may cover losses caused by data breaches and system intrusions.

Joshua Gold, Luma Al-Shibib, and Miranda Jannuzzi explain the changing cyber and privacy risk landscape in 2025. In addition, they discuss available insurance coverage, common obstacles, and practical recovery strategies.

Understanding Coverage Obstacles
Obtaining insurance coverage can be difficult. For example, insurers may raise issues involving policy applications, claim notices, exclusions, and other coverage defenses. Therefore, businesses should review their policies before an incident occurs.

Examining Cyber and Data Risks
First, the presenters examine common cyberattack methods. They also explore risks involving data storage, use, and transmission. Importantly, these exposures may arise even when no cybercriminal is involved.

Reviewing Available Insurance
Next, the program reviews the cyber insurance market and available products. Specifically, the discussion covers incident-response insurance, privacy liability, technology errors and omissions, and miscellaneous professional liability.

Addressing Privacy Claims
Finally, Part I surveys the current U.S. privacy landscape. Participants will learn about wrongful data-collection claims and related litigation. Moreover, they will examine exclusions that may restrict coverage for these emerging risks.

Luma has recovered hundreds of millions of dollars for clients in data breach, ransomware, and phishing matters under cyber, crime, and all-risk property policies. She also has experience with insurance issues in bankruptcy cases. Luma co-chairs the firm’s Diversity Committee and is active in its Women’s Network and COVID Task Group. She holds a J.D. from Temple University and a B.A. from Penn State, and is licensed in Pennsylvania and New Jersey.
